Life Care Plan Rebuttal: How Defense Counsel Challenges Future Cost Projections

In a catastrophic injury case, the life care plan is usually the biggest number in the room. Decades of attendant care, equipment replacement, therapy, and medication add up fast, and once that figure is in front of a jury it anchors everything that follows. Defense counsel who lets it stand unchallenged has conceded the damages case.

A life care plan rebuttal is how that challenge gets made.

What a rebuttal expert does

A rebuttal life care planner is usually retained to critique rather than replace. The work involves taking the plaintiff's plan apart item by item and testing each projection against the medical record, the plaintiff's actual functional status, and real-world cost data.

Sometimes the assignment goes further and the expert builds a competing plan. That happens most often when the disputed figure is large enough to justify the additional work, or when the plaintiff's plan is flawed enough that a line-item critique would not capture the problem.

The most credible rebuttals are selective. An expert who accepts most of the plan and challenges three or four specific categories reads as objective. One who disputes every line reads as hired, and juries notice.

Where life care plans are typically vulnerable

Items with no physician support. Life care planners are not physicians, and their projections are supposed to rest on recommendations that appear in the medical record. When a plan includes surgeries, therapies, or services that no treating provider ever recommended, those items are exposed. This is the single most common weakness.

Replacement schedules. A power wheelchair replaced every three years versus every five produces a dramatically different total across a forty-year horizon. Same for prosthetics, hospital beds, vehicle modifications, and home accessibility equipment. Small assumptions compound.

Level-of-care assumptions. Plans frequently project twenty-four-hour attendant care for a plaintiff whose current documented function suggests something less intensive. The gap between what the plan assumes and what the record shows is where a rebuttal expert lives.

Cost sourcing. Some planners use national average pricing rather than regional data, or cite retail rates where negotiated or Medicare rates would apply. Where the numbers came from is a fair question and often a productive one.

Duplication across categories. Large plans sometimes count the same service twice under different headings, or include both a facility placement and the in-home services that placement would make unnecessary.

Life expectancy. The horizon multiplies everything. If the plan uses a standard actuarial table without adjusting for the plaintiff's specific condition, or adjusts in a way that isn't supported, that assumption is worth testing.

Credentials that matter

The CLCP (Certified Life Care Planner) credential is the baseline, administered through the International Commission on Health Care Certification. Many life care planners come from a nursing or rehabilitation counseling background, and the underlying clinical license matters as much as the certification.

For rebuttal work specifically, ask about testimony history on both sides. A planner who has only ever worked plaintiff-side will face credibility questions when critiquing a plaintiff's plan, and vice versa. Ask how many rebuttal reports they have authored, how many have been deposed, and whether any of their opinions have been excluded.

Timing

Rebuttal work is deadline-driven in a way that original plans are not. The expert needs the plaintiff's plan, the underlying medical records, deposition transcripts, and enough runway to produce a report before the rebuttal disclosure deadline. Retaining a rebuttal planner two weeks out is how you end up with a thin report.

Give the expert the full record, not just the plan. A critique built only on the four corners of the plaintiff's report will miss the inconsistencies that make a rebuttal persuasive.
