Nursing expert witnesses evaluate whether the nursing care a patient received met the standard expected of a reasonably prudent nurse in the same setting. They review assessments, care plans, medication administration records, flowsheets, and nursing notes to determine whether nurses recognized changes in a patient’s condition, intervened appropriately, and communicated concerns to the provider in time.

Cases commonly involving nursing experts include failure to monitor vital signs or neurological status, failure to escalate a deteriorating patient, falls in hospitals and emergency departments, medication errors, pressure injuries that developed or worsened under nursing care, and triage decisions that delayed treatment. Many of these cases come down to documentation: what was charted, what was missing, and whether the timing of entries matches the rest of the record.

Nursing standards vary by setting, and the expert should match the unit where the care happened. An emergency department nurse works under different triage, monitoring, and fall-risk protocols than a medical-surgical floor nurse, and a long-term care nurse faces different staffing and assessment requirements than an ICU nurse. Courts and opposing counsel look closely at whether the expert has actually practiced in the relevant specialty, so an ICU nurse opining on emergency department triage invites a qualification challenge.

A nursing expert’s review typically covers the facility’s own policies and procedures alongside the chart. Fall-risk assessment tools, skin assessment schedules, rapid response criteria, and medication administration policies all set expectations the nursing staff was required to follow. Gaps between those internal policies and what actually happened are often central to proving a breach, and an experienced nursing expert knows where to look for them in the record.

The strongest nursing experts usually remain in active clinical practice, which helps them withstand cross-examination about whether their standards reflect current bedside care. Specialty certifications such as CEN for emergency nursing, CCRN for critical care, or WOCN for wound care add credibility, as does experience in nursing leadership, education, or quality improvement roles. Many attorneys also want an expert with prior deposition or trial testimony, though a strong clinical background matters more than a long litigation history.
