Police practices expert witnesses evaluate whether law enforcement officers and agencies acted in line with generally accepted police practices, agency policy, and constitutional standards. They review body-worn and dash camera footage, dispatch audio, incident and use-of-force reports, training records, agency policies, and internal affairs files to assess what officers knew at each moment and whether their decisions matched what a reasonably trained officer would have done.
Cases commonly involving police practices experts include excessive and deadly force, injuries during vehicle pursuits, false arrest and unlawful detention, failure to provide medical aid after an arrest or use of force, and claims that an agency negligently hired, trained, or supervised an officer. Many of these claims are brought under 42 U.S.C. § 1983, and use-of-force cases are judged under the objective reasonableness standard from Graham v. Connor, which looks at the severity of the crime, whether the person posed an immediate threat, and whether they were resisting or trying to flee.
Use-of-force analysis breaks an incident into segments. Experts look at whether officers had time and opportunity to de-escalate, whether they created the danger through their own tactical decisions, whether the force used matched the level of resistance, and whether force continued after the threat ended. Pursuit cases focus on different questions: whether the agency’s pursuit policy authorized the chase for that offense, whether supervisors monitored it, and whether the risk to the public outweighed the need to apprehend the suspect.
Claims against a city or county often require proving that a policy, custom, or failure to train caused the violation. In those cases the expert’s work extends beyond the incident to the agency itself, including training curricula, prior complaints against the officer, early warning systems, and how the department investigated and disciplined similar conduct in the past. A pattern of unaddressed complaints can matter as much as the incident itself.
The strongest police practices experts usually have long careers in law enforcement with supervisory or command experience, such as a former chief, sheriff, or training commander. Experience as a certified use-of-force or pursuit instructor, or with a state Peace Officer Standards and Training commission, adds weight. Attorneys should also consider whether the expert’s background matches the agency type involved, since practices in a large metropolitan department can differ from those of a rural sheriff’s office.
