Pharmacist expert witnesses evaluate whether a pharmacist or pharmacy met the professional standard of care when filling, verifying, and dispensing medications. They review prescriptions, pharmacy dispensing records, drug utilization review alerts, patient profiles, counseling logs, workflow and staffing data, and pharmacy policies to determine whether an error occurred and whether the pharmacy’s systems should have caught it.

Cases commonly involving pharmacist experts include dispensing the wrong medication or the wrong strength, filling prescriptions with dosing errors that should have been questioned, missing dangerous drug interactions or allergies on the patient’s profile, failing to counsel the patient, and improperly dispensing opioids and other controlled substances. Hospital and long-term care pharmacy cases add issues such as compounding and dosing errors in intravenous medications and failures in medication administration systems.

A pharmacist’s role goes beyond filling what the prescriber wrote. Pharmacists are expected to review each prescription for appropriateness, including dose, interactions, duplications, and contraindications, and to contact the prescriber when something looks wrong. Pharmacy software generates alerts for many of these problems, so experts often look at whether an alert fired, whether it was overridden, and whether the override was reasonable. Federal law requires pharmacies to offer counseling to Medicaid patients, and most states extend similar requirements to all patients.

Controlled substance cases raise distinct issues. Under federal regulations, pharmacists share responsibility with the prescriber for making sure a controlled substance prescription is issued for a legitimate medical purpose. Experts evaluate whether red flags such as early refills, patients traveling long distances, multiple prescribers, or dangerous combinations were present and whether the pharmacist resolved them before dispensing. These issues come up in both individual overdose cases and broader litigation against pharmacy chains.

The strongest pharmacist experts hold a Doctor of Pharmacy degree and current licensure, with years of practice in the same setting as the pharmacy at issue. A retail pharmacist is the right fit for a community pharmacy case, while hospital and long-term care cases call for institutional experience. Board certification through the Board of Pharmacy Specialties, pharmacy management experience, and work on medication safety or error-prevention programs add credibility when opposing counsel challenges qualifications.
