Nurse practitioner and physician assistant expert witnesses evaluate whether advanced practice providers met the standard of care when diagnosing, treating, and prescribing for patients. They review clinic and emergency department notes, orders, prescriptions, test results, triage records, and collaborative or supervision agreements to assess whether the provider recognized the patient’s condition, ordered appropriate testing, and escalated care when the case called for it.

Cases commonly involving these experts include missed or delayed diagnosis of serious conditions such as heart attack, stroke, sepsis, pulmonary embolism, and cancer, failure to refer a patient to a physician or specialist, prescribing errors and dangerous drug combinations, and negligence in urgent care centers and retail clinics where advanced practice providers often see patients with little or no physician on site. As these providers take on a larger share of frontline care, they appear in a growing number of malpractice claims.

Scope of practice is often central. State laws vary widely on how much independence nurse practitioners and physician assistants have, from full practice authority to required physician collaboration or supervision. Experts look at whether the provider acted within the limits set by state law and their practice agreement, and whether the case presented red flags that should have prompted a physician consult. When supervision was required, the analysis may extend to whether the supervising physician actually reviewed charts and was available as required.

The applicable standard of care is itself a frequent point of dispute. Some courts hold advanced practice providers to the standard of a reasonable provider in their own profession, while others compare their decisions to those of a physician performing the same task. That question affects who is qualified to testify, so attorneys often need an expert from the same profession, and sometimes a physician as well, to address both the provider’s conduct and the supervising physician’s role.

The strongest experts in this area are nurse practitioners or physician assistants who remain in active clinical practice in the same setting as the defendant, such as emergency medicine, urgent care, or family practice. Board certification through organizations such as the American Academy of Nurse Practitioners Certification Board, the American Nurses Credentialing Center, or the National Commission on Certification of Physician Assistants adds credibility. Experience supervising, precepting, or training other advanced practice providers helps an expert explain what the profession expects in practice.
