ERISA and retirement plan expert witnesses evaluate whether plan fiduciaries managed a 401(k), 403(b), pension, or other employee benefit plan in line with the duties of prudence and loyalty that ERISA imposes. They review investment committee minutes, investment policy statements, consultant reports, fee disclosures, recordkeeping contracts, and fund performance data to determine whether fiduciaries followed a sound process and acted in participants’ best interests.
Cases commonly involving ERISA experts include class actions alleging that fiduciaries kept underperforming funds on the menu too long, chose higher-cost share classes when cheaper versions of the same fund were available, paid excessive recordkeeping fees, or engaged in transactions that benefited the employer or a related party. Since the Supreme Court recognized in Tibble v. Edison International that fiduciaries have a continuing duty to monitor plan investments, many claims focus on what the committee did, or failed to do, after a fund was first selected.
ERISA cases often call for two different kinds of experts. A fiduciary process expert addresses whether the committee met regularly, used appropriate benchmarks, documented its reasoning, and acted on warning signs the way a prudent fiduciary would. An investment performance or damages expert addresses the numbers: how the challenged funds performed against appropriate benchmarks, what a prudent alternative would have earned, and how much the plan lost as a result. Some matters need both, and the two opinions have to fit together.
Damages analysis is where many ERISA cases are won or lost. The expert has to choose a defensible comparator, such as a benchmark index or a peer fund, define the period of the breach, and calculate losses across participant accounts over time. Opposing experts frequently attack the choice of comparator and the start date of the alleged breach, so the methodology needs to be transparent and consistent with how plan fiduciaries actually evaluate investments.
The strongest ERISA experts usually come from one of three backgrounds: former plan fiduciaries or investment consultants who have advised committees, academics in finance or economics who specialize in portfolio performance, and benefits professionals with recordkeeping and fee benchmarking experience. Credentials such as the CFA charter, the Accredited Investment Fiduciary designation, or a doctorate in finance add weight, and attorneys should look for experts whose prior testimony has survived Daubert challenges in ERISA cases specifically.
